WRKCS.net Acceptable Use Policy (AUP)

Our Acceptable Use Policy (AUP) is intended to help protect our customers and the Internet community in general from unacceptable use or abuse of the Internet. This Policy describes activities that constitute unacceptable use of our Internet Services, and outlines some of the actions that may be taken in the event of a violation. Use of our Internet Service constitutes acceptance of this AUP. We reserve the right to modify and update our AUP at any time.The most current version of this AUP may be found here.

Our AUP requires all of our users to comply with all applicable federal, state and local laws and regulations, but is not limited to matters of law. Our AUP also sets standards of acceptable use and behavior for those who use our Internet Service to access the Internet and it's myriad of users and services. Although we generally do not monitor customers' usage of our Internet Services to ensure compliance with law or this AUP we do reserve the right to do so when we feel that it is necessary or appropriate. We will look into possible violations of this AUP when information that is sufficient to warrant an investigation is brought to our attention. Complaints or concerns regarding possible AUP violations should be submitted to legal@wrkcs.net.

Unacceptable Uses of Internet Services

In addition to use of our Internet Services for any purpose that is illegal according to federal, state or local laws or regulations (some of which are listed below), it is a violation of our AUP to:

  • Obtain, or attempt to obtain unauthorized access to, monitor, or use any data, systems, or networks without the express permission of the owner of those systems.
  • Modify, add or remove any identifying network header information (spoofing) in an effort to deceive or make any attempt to impersonate any person by using forged headers or other identifying information. The use of anonymous remailers or anonymous browsing services does not constitute a violation of this provision.
  • Interfere with or disrupt other network users, network services or network equipment (e.g., by intentionally transmitting a virus, code, files or other data intended to limit or disrupt the function of any software, hardware or telecommunications equipment).
  • Send unsolicited bulk e-mails or mass advertising, harvest e-mail addresses for the purpose of sending bulk e-mails or mass advertising, or otherwise engage in spamming.
  • Post advertising or other mass postings to Usenet news groups that are not specifically provided for that purpose.
  • Post the same message to multiple Usenet news groups or that are off topic for any group to which you post it. Most groups have FAQs posted regularly that clearly state the types of posts that are considered to be acceptable for that specific group.
  • It is a violation of this AUP to remain logged on to our Internet Service when you are not actively using your account unless you have a dedicated access account.
  • Resell any of our Internet or other services to others without our written consent.
  • Relay mail via mail servers without express permission of owner or operator of the server you wish to use for a relay.
  • Impersonate any person or entity, including any employee or other representative of WRK Technologies, Inc.
  • Disclose your password(s) for accessing our Internet Service to a third party, or otherwise facilitate or attempt to facilitate unauthorized use of our services.
  • Transmit, post, store, link to or distribute any person's, company's or other entity's intellectual property or proprietary information, including trade secrets, trademarks, service marks or copyrighted information, without express authorization of the holder of those rights.
  • As per the terms of the Digital Millennium Copyright Act (DMCA), the accounts of users who repeatedly infringe the copyrights of others must be terminated.
  • Transmit, post, store, link to or distribute any material that is considered to be obscene, contains explicit or graphic descriptions or accounts of sexual acts or sexual language of a violent or threatening nature or constitutes child pornography under applicable law.
  • Threaten bodily harm, destruction of property or otherwise engage in harassment.
  • Transmit, post, store, link to or distribute any threatening, abusive, harassing, fraudulent, defamatory, libelous, or deceptive information about any person(s), company(ies) or other entity(ies).
  • Transmit, post, store, link to or distribute any information that is invasive of another person's privacy.
  • Transmit, post, store, link to or distribute material that victimizes, harasses, degrades, threatens harm to or intimidates an individual or group of individuals, including without limitation minors, on the basis of gender, religion, race, ethnicity, age, disability or sexual orientation.
  • Transmit, post, store, link to or distribute material that could be considered hate speech or which would tend to incite violence or civil disobedience.
  • You are fully responsible for all use of our Internet Service through your account with us. If any user of your account is suspected of violating this AUP, we may, among other things, investigate the situation, and, where appropriate, cooperate with law enforcement if a criminal violation is suspected.

Procedural Matters

  • Anyone who believes that there has been a violation of this AUP should contact us and provide the following information;
    • the nature of the alleged violation, along with any supporting evidence,
    • the date and time of the alleged violation, including the time zone,
    • the IP address or name of the host used to commit the alleged or suspected violation, and,
    • any additional information that may help us to investigate the violation.
  • Where a violation of this AUP is found to have occurred, we retain the right to determine the response that is appropriate under the circumstances, including one or more of the following actions;
    • issue a warning to the user,
    • remove any postings or other material that is in violation this AUP,
    • suspend or terminate the customer's account,
    • bill the customer for administrative costs and/or reactivation charges, and/or
    • bill the customer for our reasonable time and expenses related to corrective or legal actions required because of any violation of this AUP.
  • As set forth in our Privacy Policy, we generally do not disclose any customer-specific information to third parties without the consent of the customer, however, such disclosure may be necessary to investigate alleged violations of this AUP or to otherwise protect our rights or property. Court orders from a competent court of the proper jurisdiction requiring disclosure of any customer information to law enforcement or other authorized governmental authorities will be complied with immediately. Disclosure of customer information may also be compelled by civil legal procedures.
